    CAPS LLC (“CAPS” or "we") has developed this policy statement to assist end users ("you" or a "user") with protecting their personal privacy when using CAPS' Web site or related solutions (the "Privacy Policy"). The following information summarizes the personally identifiable information gathering and use practices for CAPS' United States Web site(s) located at the URL(s), www.capspayroll.com, capsetrain.com, and lajit.biz (collectively, the or this “Site”) and for when CAPS makes its software and services available through the Site. Personally identifiable information ("PII") includes information that can be linked to a specific individual, such as a name, address, phone number, or e-mail address. CAPS reserves the right to change this Privacy Policy at any time. If CAPS makes changes to this Privacy Policy, CAPS will post those changes at this location and provide notice of any material changes so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.   • What Information Does CAPS Collect?

    PLEASE NOTE THAT THE TYPE OF DATA COLLECTED BY CAPS WILL VARY WITH YOUR USE OF THIS SITE OR THE CIRCUMSTANCES LEADING TO YOUR USE OF CAPS' SOLUTION, I.E., THE FACT THAT USE OF THE SOLUTION MAY BE ON BEHALF OF YOURSELF OR ON BEHALF OF ANOTHER ENTITY. Below, we provide more specific examples of the types of PII CAPS may collect through the Site.

    Contact Information: CAPS may request contact information, such as your name, date of birth, address, phone number, facsimile number, and e-mail address.

    Demographic Information: CAPS may collect demographic and general profile data, such as educational, professional, and geographic information.

    Transactional Information: CAPS may maintain a database of aggregated information about the transactions on the Site, such as software or tool (and related database) utilization, registration information, and program, activity, or content selection data.

    Technical Information: CAPS may also collect technical information from users of the Site, such as Internet Protocol (IP) addresses or the date and time of access. CAPS may also catalog the Web page(s) on the Site accessed or type of browser or operating system used.

  • How Does CAPS Use that Information?

    CAPS collects various PII (as described above) from different parts of its Site primarily to provide and continue to improve its software and services. CAPS gathers most information during the registration processes it utilizes for the benefit of its customers and/or to enable use of certain online software or services. But, CAPS may request PII at other times, including, but not limited to, when you report a problem with the Site or when you request to receive communications from CAPS.

    The Site offers two different levels of access and use: (1) publicly available information areas operated by CAPS and (2) registered user areas where an individual can access certain software and tools implemented by CAPS on its own behalf or on behalf of a customer(s) that retains CAPS to utilize its solutions in connection with your access (the "Registered User Section(s)"). Consequently, until you register, participate in an application process, sign up for a program or event, or request to receive information from CAPS, you are able to browse the Site without providing any PII, although your browser may tell us certain kinds of technical information. Please note, however, that when you decide to provide PII to CAPS, you may share that information not only with CAPS but also with third parties that CAPS utilizes to process certain information as well as with the customer that has retained CAPS to utilize its software.     Contact Information: CAPS may use your contact information in connection with the provision of its software and services (including with its third party business partners) and to enable you to participate in the Site's other activities, applications, and offerings. CAPS may also use your contact information to facilitate registration with a particular program or event, to advertise its services, to contact you regarding a survey, or to get in touch with you when necessary with respect to transactions conducted through the Site, material changes in the Site’s policies and agreements, new services CAPS may offer, or otherwise. But, except for the foregoing, we do not share your contact information with third parties for other purposes, except to a court or governmental agency if required by law.

    Demographic Information: CAPS may use demographic information for administrative, management, and monitoring purposes in order to continue to improve the Site and the quality of CAPS' software and services. In addition, CAPS may share aggregated demographic data collected through the Site with its business partners, customers, the general public, the news media, and with the U.S. Government and state governments, not only as may be required by law, but also for advertising purposes, for release to third parties, and to participate in government programs and initiatives. But, such information will not identify any particular user.

    Technical Information: CAPS may use technical information, such as your IP address or browser type, to help diagnose problems with CAPS' servers, analyze Site usage trends, track user movements on the Site, and to otherwise manage, monitor, and improve the Site and its related software and services.

    Legal Action: CAPS may disclose PII when legally required to do so in accordance with government requests or regulations or legal proceedings. CAPS may also disclose PII to protect against misuse or unauthorized use of the Site or as is otherwise required to limit legal liability, protect or defend CAPS' rights, property, or interests, or protect the safety, rights, or property of the Site's users.

    Business Transactions: In the event that CAPS goes through a business transaction, such as a merger or acquisition by another company, involving the sale of all or a portion of its assets, please note that the PII collected and retained by CAPS may be among the assets transferred. In the event a transaction of this kind occurs that results in the transfer of PII, CAPS will notify you via e-mail and/or place a prominent notice on the Site for 30 days of any such change in ownership or control and the possible changes to this Privacy Policy.

  • What about the Use of Cookies or Other Information Gathering Tools?

    CAPS may use cookies and/or other programming techniques to enhance and/or monitor your experience while using the Site. Cookies and other related techniques are generally pieces of information, which CAPS uses for record-keeping purposes, which the Site transfers to us and/or your computer’s Web-browser for storage on your computer’s hard drive.     As is appropriate for the nature of PII collected and stored by CAPS, the Site has industry standard and commercially reasonable security measures or safeguards in place to protect against the loss, misuse, and alteration of the PII under CAPS’ control. Although CAPS has endeavored to create a secure and reliable Site, however, the confidentiality of any communication or material transmitted via the Internet cannot be guaranteed. Accordingly, you should consider carefully if you want to submit sensitive information via the Internet.

  • What about “Opting-Out” of Data Collection and Use?

    The collection, use, and distribution of your PII is necessary for CAPS to provide certain software and services and to otherwise operate the Site. For example, all users who register with or utilize the Registered User Section(s) or seek to receive information from CAPS or use CAPS' software or system will need to agree to CAPS' use and collection of PII. But, participation with CAPS' programs or services are voluntary and as you are otherwise permitted to browse through and access the non-restricted areas of the Site, you can decide on your own if you wish to provide your PII or opt-out of doing so. Thus, to a large extent, you can control the information you provide or share with CAPS and/or its business partners.

  • What about Correcting, Deleting, or Updating Information?

    You may contact CAPS to correct, modify, or delete the PII you provide to CAPS through this Site. In the event that CAPS receives such a request or change and the related PII is under CAPS' control, CAPS may require you to confirm or verify any change to your record. Please note, however, that the collection and uses of certain PII is necessary to provide certain services, functionality, or information through the Site and the deletion of such necessary PII may render a particular service or functionality or CAPS' ability to provide it inoperable.

  • What about Children?

    CAPS cares about the safety of children on its Site and encourages parents and guardians to monitor their children’s use of the Internet. Although the Site is suitable for a general audience, this Site is intended for use only by users who are over 18 years of age or the legal age of majority. Accordingly, CAPS does not knowingly solicit PII from children or send them requests for personal information.
